Please read these Terms of Use (“Terms”) carefully before using the website https://bluecollarpettransport.com (the “Service”) operated by Blue Collar Pet Transport (“Company”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and others who access the website.

2.1 Overview of the SMS Program
By opting into SMS communications from Blue Collar Pet Transport, you agree to receive recurring text messages related to:
- Your transport booking
- Driver updates
- Delivery notifications
- Customer service communications
- Promotions or informational alerts related to our services
Messages may be sent using manual texting, automated systems, or auto-dialer technologies, consistent with TCPA and FCC requirements.
2.2 Updated 2024–2025 FCC One-to-One Consent Rule
Effective under the FCC’s 2024 ruling:
- You must give explicit, individual consent specifically for Blue Collar Pet Transport.
- Consent cannot be shared, bundled, transferred, or implied.
- We cannot send you marketing messages without separate and clear opt-in authorization.
- Consent cannot be required as a condition of purchasing our services.
2.3 How You Provide Valid Consent
You may opt in using:

Selecting a clearly labeled checkbox that states:
“I agree to receive SMS messages from Blue Collar Pet Transport. Message frequency varies. Message/data rates may apply. Reply STOP to cancel, HELP for help.”
This checkbox cannot be preselected.

You may text a designated keyword to opt in, such as “START” or “YES,” after receiving a compliant consent request.
2.4 Message Frequency
Message frequency varies based on service activity and customer requests.
During high-activity events such as transport updates, you may receive up to 5 messages per day.
Standard message and data rates may apply.
2.5 Opt-Out Instructions (FCC Updated Revocation Standard)
You may revoke consent at ANY time using any reasonable method, including:
- Replying “STOP”
- Replying “UNSUBSCRIBE”, “END”, “CANCEL”, “QUIT”, etc.
- Emailing us
- Calling us
- Requesting removal verbally
- Submitting a written request
FCC rules require us to honor any reasonable expression of a desire to stop messages, not only “STOP.”
Once you opt out:
- You will receive a final confirmation message.
- You will not receive further SMS messages unless you opt in again.

2.7 One-to-One Consent for Marketing Messages
Under FCC 2024 rules, transactional messages (updates, service alerts) require basic consent.
However, promotional or marketing SMS requires:

- Clear disclosure of marketing content
- Documentation that you agreed to receive marketing messages specifically
We do not send marketing SMS without this separate explicit consent.

Blue Collar Pet Transport is not responsible for these charges.
2.10 Carrier & System Limitations
We cannot guarantee:

- Delivery speed
- Network availability
- Timeliness of updates
SMS delivery depends on your carrier and network performance.
2.11 Supported Carriers
Our SMS program works with all major U.S. carriers.
Some regional carriers may have limited support.
- Your Representations
By opting in, you confirm:
- You are the owner or authorized user of the phone number provided.
- You are 18 years or older and a U.S. resident.
- You will notify us immediately if your phone number changes.
You agree to indemnify us for any claims arising from your failure to update your number.
- Changes to SMS Terms
We may update these Terms to comply with new FCC/TCPA rules or business needs.
Changes take effect when posted to our website or when sent via SMS.
Continued participation is considered acceptance of updated Terms.
- Suspension or Termination
We may suspend SMS messaging if:
- Your number becomes unreachable
- Your mobile service lapses
- You violate these Terms
- Carrier rules require it
We may discontinue SMS messaging at any time.
- Release, Warranty Disclaimer & Limitation of Liability
The SMS Program is provided “as is” and “as available.”
We disclaim all warranties, express or implied.
To the fullest extent permitted by law:
- We are not liable for damages arising from message failures.
- We are not liable for lost profits or consequential damages.
- Total liability is limited to $10.00.
- Arbitration & Class Action Waiver
All disputes relating to these Terms or SMS messages must be resolved by binding arbitration under AAA Consumer Arbitration Rules.
You waive the right to:
- Bring claims in court
- Participate in class actions or representative actions
- Seek jury trials
Arbitration will take place in Florida, unless agreed otherwise.
- Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
